This Trademark Policy outlines how KGM Holdings International Limited ("we", "us", "our") protects and manages the use of our registered trademark "The Gold House®" (the "Trademark") under the Trade Marks Act 2002. The Trademark represents our brand identity in the precious metals and bullion industry. Unauthorized use may infringe our rights and lead to legal action.
1. Ownership and Rights
- We own the exclusive rights to the Trademark in New Zealand for goods and services related to gold, silver, bullion, precious metals, and associated retail/trading services.
- The Trademark must always be used with the ® symbol to indicate registration.
- No third party may use the Trademark without our prior written consent.
2. Permitted Use
- Internal Use: Employees and contractors may use the Trademark in official communications, marketing materials, and business documents, provided it aligns with our brand guidelines (available upon request).
- Authorized Partners: Suppliers, affiliates, or partners may use the Trademark only under a written licence agreement, specifying scope, duration, and quality controls to maintain brand integrity.
- Fair Use: Descriptive or nominative use (e.g., referring to our business in news or reviews) is permitted if it does not imply endorsement or affiliation, and complies with the FTA (no misleading conduct).
3. Prohibited Use
- Do not alter, distort, or combine the Trademark with other marks.
- Do not use the Trademark in a way that suggests sponsorship, endorsement, or association without permission.
- Do not register domain names, social media handles, or trademarks incorporating "The Gold House" or similar terms.
- Prohibited in counterfeit goods, deceptive advertising, or any illegal activity.
4. Enforcement
We monitor for infringements and will take action, including cease-and-desist letters, legal proceedings, or reports to IPONZ (Intellectual Property Office of New Zealand).
