These Terms and Conditions ("Terms") govern all purchases, sales, and related services provided by KGM Holdings International Limited trading as The Gold House® ("we", "us", "our") to you ("you", "your", the "Customer"). By placing an order, creating an account, or using our services (including our website at www.thegoldhouse.co.nz), you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Interpretation

Account
means any account we maintain for you to facilitate purchases, sales, or inquiries.
Bullion
means investment-grade gold (min. 99.5% purity) and silver (min. 99.9% purity) in bars, coins, or other forms we offer.
Business Day
means any day other than Saturday, Sunday, or a public holiday in New Zealand.
Confirmed Order
means an order confirmed upon receipt of cleared funds within the specified time.
Product
means bullion, precious metals, coins, safes, or other items we sell.
Purchase Window
means the time (e.g., 10 Minutes) during which quoted prices are fixed, as notified.

2. General

  • You must be at least 18 years old and provide accurate identification for AML/CFT compliance.
  • These Terms apply to all dealings and supersede prior agreements. Governed by New Zealand law; disputes subject to non-exclusive jurisdiction of New Zealand courts.
  • We do not provide financial, tax, or investment advice. You are responsible for assessing suitability and obtaining independent advice.
  • We may record communications and rely on instructions from authorised persons until revoked in writing.
  • We may correct errors (including reversing transactions) and suspend services in volatile markets or for compliance reasons.

3. Quotes and Orders

  • Quotes are indicative and expire after the Purchase Window (e.g., 10 Minutes) or sooner in volatile conditions.
  • Orders are binding upon confirmation; no cancellation except at our discretion.
  • Payment must be in cleared funds by the due date. Late payment may incur default fees (e.g., NZ$350 + GST), interest (2% above bank overdraft rate), and liability for market losses.
  • Title passes upon full payment and delivery/collection confirmation.
  • GST: Exempt for investment-grade bullion; otherwise applicable.

4. Buying Products

  • Specify quantity and spend amount. We confirm via invoice or order confirmation.
  • We may require proof of identity and source of funds for AML/CFT.
  • Prices locked only during Purchase Window; volatile markets may lead to suspension.

5. Selling Products to Us

  • Contact us for buy-back quote. We may purchase at prevailing rates, subject to verification.
  • You warrant good title, free of encumbrances.
  • Settlement in cleared funds after inspection or as communicated.

6. Delivery and Collection

  • Products available for collection or delivery (at your cost).
  • Risk and title pass upon collection or signed delivery (secure courier recommended).
  • Delays may occur; no liability for consequential loss.

7. Returns and Refunds

  • No returns for bullion due to market volatility, except for defects (subject to CGA for consumers).
  • Faulty items: Notify within 7 days; we may exchange or refund after inspection.

8. Default and Remedies

On default, we may charge admin fee, interest, recover losses, suspend services, and sell any held assets to recover amounts (after notice).

You indemnify us for reasonable losses from your breach.

9. Limitation of Liability

To the extent permitted by law, we exclude liability for indirect/consequential loss, market fluctuations, third-party info, or system failures.

For consumers under CGA, nothing limits your rights (e.g., acceptable quality). CGA does not apply to business purchases.

10. Variation and Notices

We may vary Terms on 14 days' notice (or immediately for security/law). Continued use constitutes acceptance.

11. Privacy

We collect and handle personal information per our Privacy Policy and Privacy Act 2020.

12. Miscellaneous

  • No assignment by you without consent; we may assign.
  • Severability: Invalid provisions replaced with closest valid equivalent.
  • Force Majeure: No liability for events beyond control (e.g., market disruptions, pandemics).
